Nitrogen that leaves a field ends up in drinking water and rivers, so the law makes every application of it a planned, written and dated event. The rule that does this in England has the same shape as the rule in every EU member state, because both come from the same directive, and the same shape again in the US states that require a nutrient management plan.

The Law, In Plain Words

A nitrate vulnerable zone (NVZ) is land that drains to water where nitrate is high or rising. About 55% of England is designated [3]. If any of your land is in a zone, The Nitrate Pollution Prevention Regulations 2015 apply to that land [1]. They bind whoever occupies it: owner, tenant or the contractor in charge. The duties are these.
  • Plan before you spread. Work out the nitrogen already in the soil, work out what the crop needs, and write a plan for the season (regulation 10) [1]. The guidance points to RB209 for the standard values [2][6].
  • Stay under the whole-farm manure limit. Nitrogen in livestock manure, spread or left by grazing animals, must not exceed 170 kg for every hectare of the holding in a calendar year (regulation 7) [1].
  • Stay under N max. The total nitrogen on a crop, manufactured and organic together, must not exceed the crop’s limit in any twelve-month period (regulation 12) [1].
  • Keep to the closed periods. Manufactured fertiliser, and organic manure with a high share of readily available nitrogen such as slurry, poultry manure and digestate, cannot go on between set dates (regulations 20 and 22) [1].
  • Write it down within one week. Every spreading, every crop sown and every load of manure brought onto the holding is recorded within a week (regulations 28 to 31) [1].
  • Keep it five years. A record is kept until five years after it stopped being current (regulation 35) [1].
The numbers behind those duties: N max for the main crops, in kg N/ha [2]: The record itself holds the name and area of each field, the crop, soil type and sowing date, the soil nitrogen supply, the expected yield and the crop nitrogen requirement. For each organic manure application it holds the area, quantity, date, method, type of manure and total nitrogen. For manufactured fertiliser it holds the date and the amount of nitrogen. It also holds the yield of each arable crop and the livestock kept, their numbers and their days on the holding [2]. The Environment Agency enforces the regulations (regulation 43). A breach is a criminal offence and carries a fine on summary conviction or on indictment (regulation 41) [1]. The guidance says it plainly: if you don’t comply, you may be prosecuted and fined [2]. England has a second rule that applies on every farm, inside a zone or not. Under The Reduction and Prevention of Agricultural Diffuse Pollution (England) Regulations 2018, the Farming Rules for Water, each application of manure or fertiliser is planned so that it does not exceed the needs of the soil and the crop (regulation 4). On cultivated land the plan uses a soil test for pH, nitrogen, phosphorus, potassium and magnesium that is no more than five years old (regulation 5) [4]. The Environment Agency inspects, asks to see the nutrient plan and the fertiliser records, and gives advice first. Where pollution has happened or is likely it can issue notices, impose fixed or variable penalties, or prosecute [4][5]. The statutory guidance accepts RB209, farm software or a qualified adviser as the basis of the plan [6].

Where It Applies

The English regulations transpose an EU directive, so the same duties appear across Europe under different names. In the United States there is no federal nitrogen law for farms; the duty sits in state law and in a national practice standard that state rules borrow from. Three state examples show the range. Maryland requires a plan from any farm grossing $2,500 a year or more, or keeping 8,000 lb or more of live animal weight. The plan is written by a certified planner, soil is sampled at least every three years, manure is analysed at least every other year, an annual implementation report is filed by 1 March, and manure cannot be spread from 16 December to 1 March [8]. Delaware requires a plan and certification from anyone with 8 or more animal units or applying nutrients to 10 acres or more, with an annual report [9]. Wisconsin sets performance standards in NR 151 and the farm rules in ATCP 50, both built on the Wisconsin version of NRCS Standard 590, and makes a plan a condition of farmland preservation payments, cost-share, a large livestock permit or a local manure ordinance [10]. Standard 590 itself is the national practice standard for managing the amount, source, placement and timing of plant nutrients, and every state publishes its own version of it [10].
